Mr.Nawal Kishore Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 11-07-2025 Heard Mr. Ranjit Kumar, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned APP for the State.

2. Petitioner seeks regular bail in connection with Bandeya P.S. Case No. 27/ 2025 dated 28.02.2025 registered for the offence(s) punishable under Section(s) 25(1B) a and 26 of the Arms Act.

3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to the recovery of one country made pistol and two cartridges from a thatched house belonging to the petitioner but, in fact, the petitioner has no connection with the said place. In the seizure list, the place of recovery has not been shown rather the name of the village has been shown from which the recovery is said to have been made

Patna High Court CR. MISC. No.41757 of 2025(2) dt.11-07-2025 2/2 and further, signature of the petitioner was not taken on the seizure list while he is said to have been arrested from his house. It is further submitted that there is no independent witness to the recovery of the alleged firearms and only the police officials were made the witnesses. It is lastly submitted that the petitioner has fair and clean antecedent and languishing in jail since 01.03.2025 and against him the investigation has been completed.

4. Learned APP for the State has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the petitioner's fair and clean antecedent as well as completion of investigation against him and also his custody period, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner namedabove be released on bail in connection with Bandeya P.S. Case No. 27/ 2025 on furnishing bail bond of Rs.20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
