Petitioners apprehend their arrest in connection with a case registered under Sections 341, 323, 307 and 379/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation in brief is that all nine accused persons variously armed assaulted the informant and one Anil Yadav. It is submitted that in fact, the informant side of this case was aggressor and prior to that case, Manjhagarh P.S. Case No.64 of 2017 was filed by the petitioner side against the
Patna High Court Cr.Misc. No.30446 of 2017 (2) dt.10-07-2017 2/2 informant side and in the case lodged by the petitioners several persons have sustained injury including the injury of fire arm. However, in the present case, the injury of Anil Yadav is simple in nature and another injury of the informant is on the palm of which the final opinion is reserved.
Learned counsel for the informant submits that the injury of the informant is reserved.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Sanjay Singh, Surendra Singh, Lalbabu Singh, Ranjeet Singh, Subhash Singh, Pankaj Singh, Rahul Singh and Aman Singh @ Golu Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj, District- Gopalganj in connection with Manjhagarh P.S. Case No.65 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
