1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Konch Police Station Case No. 19 of 2024, disclosing offences under Sections 341, 323, 324, 307, 34 of the Indian Penal Code.

3. As per the prosecution case, on 07.01.2024, the son of the informant went to play cricket in the nearby village and during that course, co-accused Kundan Kumar was not allowing the informant's son to play due to which some scuffle took place. The petitioners who are mother and sister of co-accused Kundan Kumar arrived there

Patna High Court CR. MISC. No.45080 of 2024(2) dt.24-07-2024 2/3 assaulted the son of the informant by iron rod due to which they sustained injury.

4. Learned Counsel for the petitioners submits that petitioner no. 1 is mother of the co-accused Kundan Kumar and petitioner no. 2 is the married sister of Kundan Kumar. They have falsely been implicated in this case on the trivial issue of scuffle during the game of cricket. The injuries caused to the informant's son are simple in nature as would be evident from the impugned order dated 04.05.2024.

Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that the injuries caused to the informant's son are simple in nature and the petitioners are women, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial
