The petitioner apprehends his arrest in Nardiganj P.S. Case No. 28/2015, registered for the offences punishable under Sections 406, 420, 467, 468, 471, 472/ 34 of the Indian Penal Code.

The sum and substance of the allegation against the petitioner is that the petitioner being Head Master of the school is alleged to have misappropriated Rs. 3,56,891.50. Sri N.K. Agrawal, learned counsel for the petitioner submits that the petitioner is ready to deposit entire amount within four months, subject to the result of the case. Considering the facts aforesaid and the fact that the petitioner is ready to deposit the entire amount of Rs. 3,56,891.50 within four months, the petitioner above named in the event of his

No.34779 of 2015 (4) dt.07-12-2015 arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 28/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

If the petitioner fails to deposit the aforesaid amount in the account of the Education Department or the account of School within four months, the court below shall cancel the bail bond of the petitioner.
