Petitioner seeks bail in Sessions Trial No.370 of 2017 arising out of Jogapatti P.S. Case No.345 of 2016. The prayer for bail of the petitioner was earlier rejected by this Court. A report was called for and S.P., West Champaran, Bettiah reported that all the witnesses have already been examined as I.O. was examined on 21.08.2019 and Uma Shankar Baitha, one of the prosecution witnesses, is reported to have died and the prosecution has no other witness to be examined.

Taking into consideration the fact that trial is at fag end, I am not inclined to enlarge the petitioner on bail.

The trial court is directed to conclude the trial within three months after hearing both sides.
