JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-07-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.
Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Nauhatta P.S. Case No. 104 of 2020, registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code.
The accusation is that Amarnath Kumar, nephew of the informant, Lalan Das, was returning to his house from

No.38341 of 2020(2) dt.07-07-2021 2/3 Muradlpur Hat but in the way, both petitioners objected him why he pressing the horn of the motorcycle then his nephew, Amarnath Kumar replied that since both persons are in the way, hence, he has pressed the horn of motorcycle. Thereafter, both petitioners started to abuse and caused assault through fist and slaps. On raising alarm, informant, his cousin bother Lalit Kumar and brother-in-law Amar Kumar rushed to save Amarnath Kumar then they were also assaulted. In course of occurrence, his mother, Sumitra Devi, was also sustained injury at her hand.
Learned counsel for the petitioners submits that due to dirty village politics, both petitioners have falsely been implicated in the present case. Moreover, the injuries, as found on the person of injured, Lalan Kumar, Lalit Kumar, Amar Das and Sumitra Devi, are simple in nature.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Nauhatta P.S. Case No.
Patna High Court CR. MISC. No.38341 of 2020(2) dt.07-07-2021 3/3 104 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
