JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-07-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 365, 302, 201, 120(B) of the Indian Penal Code.

It is a case of commission of murder of the married daughter of the informant by all the accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named

During the course of investigation, the mobile phone of the deceased was recovered from the possession of co-accused Javed who confessed that he had purchased the same from co-accused Arman. Subsequently, the husband of the deceased confessed his guilt and stated that petitioner was also involved in the commission of murder of the deceased. The said Arman and Jawed have been granted bail by a coordinate Benches of this Court vide orders dated 03.06.2020 and 20.11.2019 passed in Cr. Misc. Nos. 63765 of 2019 and 60623 of 2019. The petitioner is languishing in custody since 24.01.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,
