No counter affidavit has been filed on behalf of the University.

From the pleadings on record particularly Annexure-7 thereof it appears that the grievance of the petitioner was earlier addressed by the Vice Chancellor whereafter an enquiry was made by the Inspector of Colleges.

Counsel for the petitioner has drawn attention of the Court to the recommendation thereof, from perusal whereof it appears that in the light of the request made by the Principal of the College in 1997 the matter concerning the petitioner is still pending final decision by the appropriate/competent authority which, according to the petitioner, is the Vice Chancellor, Veer Kunwar Singh University, Ara. In his submission, the application be disposed of by directing the Respondent Vice Chancellor to take a final decision in respect of the grievance of the petitioner

Patna High Court CWJC No.19025 of 2010 (3) dt.15-01-2015 2 / 2 taking into account the relevant facts including the report of the Inspector of Colleges (Annexure-7).

Counsel for the University appreciating the said stand of the petitioner states that if the grievance of the petitioner has not till date been adjudicated upon by the competent authority then the Court may issue direction for taking appropriate decision in accordance with law.

Considering the statements made at Bar this Court is satisfied that the present writ application be disposed of by the following order:- Let a fresh representation be filed by the petitioner enclosing therewith all relevant documents ventilating his grievance as raised in this writ application before the Vice Chancellor (respondent no.2) whereafter the said respondent will consider the same and pass appropriate/reasoned order thereon preferably within two months from its filing/presentation.
