JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The accusation is of making assault and abusing by calling caste name for not removing firewood from the pathway. It is submitted by the learned counsel for the petitioners that for the occurrence of 26.5.2015 at 2 P.M. the FIR was registered on 27.5.2015 at 9.30 AM. The accusation has been

Patna High Court Cr.Misc. No.35111 of 2015 (2) dt.03-09-2015 2/2 levelled for making request to remove firewood from the pathway when petitioner no. 1 earlier lodged Chhauradano P.S. Case No. 90 of 2015 against the informant. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Raxaul at Motihari in connection with Chhauradano (Mahuawa) P.S. Case No. 91 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
