The petitioner seeks bail in Shambhuganj P.S. case No. 136 of 2016 under Section 7 of the Essential Commodities Act.

The petitioner was driving an auto rickshaw bearing registration No. BR51P-0198 and he was carrying 14 bags of rice. The petitioner is said to have disclosed that he purchased the rice from Aanganbari Sevikas and was going to sale the same in market.

The learned counsel for the petitioner submits that petitioner was purchasing the rice for his own use. The petitioner is in jail since 28.09.2016. The petitioner has already remained in jail for three and half months.

Considering the facts aforesaid and the nature of

No.1325 of 2017 (2) dt.16-01-2017 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Banka in Shambhuganj P.S.
