The petitioner seeks bail in anticipation of his arrest in connection with Pannapur P.S. Case No. 133 of 2021 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel submits that the case of the petitioner is similar to that of Ajay Nat who was granted benefit of anticipatory bail by this Court. The petitioner does not own the motorcycle and ex facie case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, is not made out against the petitioner.

I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
