JUSTICE SANJAY PRIYA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 414, 420, 400, 467, 468, 469, 471 and 120(B) of the Indian Penal Code.

It is alleged in the written report that police got secret information that Ravindra Sahni and Babloo Paswan who were lodged in Rosera jail in connection with loot and dacoity, were planning to commit loot. The petitioner along with one Suraj Paswan was apprehended on motorcycle who told the informant that the motorcycle has been provided to them by Babloo Paswan and they have gone to meet him for planning to commit loot and dacoity in a petrol pump. In this manner, mere suspicion has been raised in the written report against the petitioner. Besides this, there is no specific overt act alleged against the petitioner. The

Patna High Court Cr.Misc. No.865 of 2017 (2) dt.12-01-2017 2/2 petitioner is in custody since 8.7.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai (Samastipur), in connection with Dalsingsarai P.S. Case No. 252 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
