25-10-2016 Heard Sri Sandip Kumar Gautam, learned counsel for the petitioner and Dr. Indiwar Kumari, learned Addl. Public Prosecutor.

The petitioner, who is in custody since 13-05-2016 in Begusarai (Town) P.S. Case No. 235 of 2016 registered for offence under Sections 419, 420 of the Indian Penal Code, has prayed for grant of bail.

By way of referring to statement made in paragraph - 3 of the petition, it was submitted by learned counsel for the petitioner that petitioner is having clean antecedent. He submits that petitioner has falsely been implicated. By way of referring to F.I.R., he submits that accusation appears to be not probable. Learned Addl. Public Prosecutor has opposed the prayer for bail

No.46215 of 2016 (2) dt.25-10-2016 2/2 However, considering the nature of accusation, period of custody as well as clean antecedent of the petitioner, let the petitioner namely Shambhu Sah be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 235 of 2016.
