The petitioner is languishing in custody for the offences punishable under Sections 8, 20, 22, 25 of the N.D.P.S. Act.

64 kg. of Ganja was allegedly recovered from the house of the petitioner and petitioner was arrested at the spot. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. For two days the petitioner was detained at the police station. Investigation of the case is already complete. It is a case of false implication. Considering the nature of allegation against the petitioner and no material to substantiate that the petitioner

No.38428 of 2020(4) dt.27-07-2021 2/2 would not commit such offence in future or to assume that the petitioner is not involved in the offence alleged and considering the mandate of Section 37 of the N.D.P.S. Act, I am not inclined to enlarge the petitioner on bail. Hence, prayer for bail is refused in connection with NDPS Case No. 19 of 2019 arising out of Doriganj P.S. Case No. 192 of 2019 pending in the court of learned Sessions Judge, Saran at Chapra.
