The sole petitioner, invoking writ jurisdiction of this Court under Article 226 of the Constitution of India, has made a prayer for directing the Respondents, especially Respondent no.3/ Commissioner, Darbhanga Division, Darbhanga to decide Anganbari Appeal no.05 of 2014, which was filed against the order dated 13.08.2014 passed by the District Magistrate,
Patna High Court CWJC No.4 of 2015 (4) dt.18-01-2017 2/2 Darbhanga in Case no.123/2008-09 within time framed. Besides, making prayer for directing the Respondents for disposal of the appeal, the petitioner has also prayed for other reliefs. However, at the time of hearing, learned counsel for the petitioner confines the relief only for directing the Respondents for disposal of the said appeal.
The Court is of the opinion that since in the present writ petition, only a limited prayer has been made for disposal of Anganbari Appeal, there is no reason to keep the matter further pending. The writ petition stands disposed of with observation that the learned Commissioner may take final decision in Anganbari Appeal No.05 of 2014 preferably within a period of eight weeks from the date of receipt/production of a copy of this order after hearing all concerned parties.
