NILU AGRAWAL ORAL ORDER 09-09-2015 Heard learned counsel for the petitioner Sri Manish Kumar and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bodh Gaya P. S. Case no. 222 of 2014 for the offence alleged under Sections 467, 468, 471, 420, 419, 120B, 409 and 34 of the Indian Penal Code.

The prosecution case is that petitioner worked as a clerk in the Primary Health Centre, Bodh Gaya. He along with other coaccused misappropriated huge money by manufacturing fake documents.

It has been submitted by the learned counsel for the petitioner that he has a clean antecedent and no specific allegation has been made against him. It has further been submitted that he was only an Accounts Clerk in the Health Centre and had never signed any bill nor had any knowledge of such defalcation. Patna High Court Cr.Misc. No.37154 of 2015 (2) dt.09-09-2015 2 / 2 granted the privilege of anticipatory bail in Cr. Misc. no. 22261 of 2015 vide order dated 28.7.2015.

Under such circumstances, let petitioner, namely, Ram Lakhan Paswan, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Bodh Gaya P.
