Petitioners being the brother, mother and unmarried sister of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B, 420, 201, 120B of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Accusation is killing the daughter of the informant after one year of marriage for non-fulfillment of dowry demand.
It is submitted by the learned counsel for the petitioners that though the case was registered in 2001, but process was instituted against the petitioners as at they are
Patna High Court Cr.Misc. No.36171 of 2015 (2) dt.07-09-2015 living at different places. The complaint was filed with inordinate delay. The death of the victim has not been ascertained, whereas the accusation is omnibus and general. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Lalganj P.S. Case No. 236 of 2001, pending in the court of learned Chief Judicial Magistrate, Hajipur, Vaishali.
With this observation this application is disposed of.
