JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 This application is for grant of regular bail in connection with Chakai P.S. Case No. 152 of 2012 registered for the offence(s) under section(s) 328, 302/34 of the Indian Penal Code. Petitioners are the mother-in-law and brother-in-law of the deceased. The case is of section 302 of the Indian Penal Code. It has been submitted on behalf of the petitioners that no specific allegation has been attributed against them whereas fardbeyan itself shows that grandson of the informant has informed him that her mother has taken some spurious drug and there is no allegation of strangulation and further both petitioners are in custody for about five months.

Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed.

Patna High Court Cr.Misc. No.31584 of 2017 (2) dt.13-07-2017 2/2 Let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Chakai P.S. Case No. 152 of 2012, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine rhyme or reasons, the prosecution will have liberty to move for cancellation of their bail.
