Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act.
From the Bolero vehicle of the petitioner 140 Kgs of ganja were recovered.
It is submitted by learned counsel for the petitioner that the vehicle in question was taken by the driver for its personal use when the recovery was made and admittedly the petitioner was not present in the vehicle at the time of seizure.
The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Majhaulia P.S.
Patna High Court Cr.Misc. No.39295 of 2013 (2) dt.24-12-2013 2 / 2 Case No. 389 of 2012, pending in the Court of learned District & Sessions Judge, West Champaran, Bettiah.
With the observations above, the application stands disposed off.
Let the order of this Court be transmitted through FAX to the learned Court below at the cost of the petitioner.
