JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-12-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in connection with Excise Case No. 7 of 2013 registered for the offences punishable under Section 47(a)(f) of the Excise Act pending in the court of learned SDJM, Raxaul at Motihari.
Recovery is of 175 litre of country made liquor, 200 Kg. of fermented materials and other manufacturing equipments. It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house of the petitioner and a statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of regular bail to the petitioner preferably on the same day if he surrenders within a period of six weeks. With the above observation, this application is, accordingly, disposed off.
