The petitioners have preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30(a), 36 and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 270 litres of liquor was recovered from the ambulance and the two petitioners were taken into custody while the other accused escaped. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. They have no concern either with the seized liquor or with the vehicle in question. The petitioners are in custody since

Having heard learned counsel for the parties and taking into consideration the petitioners having remained in custody for more than 6 months and having no criminal antecedent, the Court directs the above two petitioners to be enlarged on bail in connection with Bahadurganj P.S. Case no. 212 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge II, Special Judge (Excise), Kishanganj. (Partha Sarthy, J) Prakash/- U
