JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,357,307,448,379 and 506/34 of the Indian Penal Code.
It is alleged that petitioner no. 4 Pradeep Yadav assaulted with iron rod on the head of the informant Devki Devi when Prabhash Yadav came to rescue then he was also assaulted by co accused Mithu Yadav (non petitioner). It is further alleged that when the injured was being taken to hospital then the accused persons including the petitioners obstructed and petitioner no. 1
Patna High Court Cr.Misc. No.34454 of 2015 (2) dt.18-08-2015 2/2 took away cash of Rs.27000/-.
It is submitted by the learned counsel for the petitioners that the injuries of Devki have been found to be bruise, abrasion and pain in body, simple in nature. There is counter version of the occurrence and the petitioners have also received injuries. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Purnea in connection with K. Nagar P.S. Case No. 185 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
