JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-04-2021 Heard Mr. Uday Chand Prasad, learned Advocate for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Chausa (O.P. Falaut) P.S. Case No. 80 of 2020, dated 24.03.2020, instituted for the offences under Sections 448, 341, 323, 307, 354(B), 380, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms

It has been alleged in the F.I.R. that the petitioners fired from their weapons and also assaulted the members of the prosecution party but nobody has been injured in the occurrence.

It has been submitted on behalf of the petitioners that an absolutely false case has been lodged because of land dispute between the parties. The petitioners are covillagers of the informant and seeing the falsity of the accusation, the parties have decided to settle their differences and compound the case.

Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chausa (O.P. Falaut) P.S. Case No. 80 of 2020, subject to

Patna High Court CR. MISC. No.37515 of 2020(2) dt.09-04-2021 3/3 the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
