JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-07-2022 Petition for pre-arrest bail of petitioner no. 2 has already been dismissed as withdrawn vide order dated 12.4.2022. Heard learned counsel for the petitioner no.1 and the State.

The petitioner apprehends arrest in a case registered for the offence punishable under sections 304B/201/34 of the Indian Penal Code.

It is a case of dowry death.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner and no specific overt act has been alleged against

Patna High Court CR. MISC. No.50383 of 2021(7) dt.12-07-2022 2/2 him, who happens to be father-in-law of the deceased. It is further submitted that the petitioner is separate in mess and business. Thrust of allegation is against the husband of the deceased who is already in custody.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate II, Danapur, Patna in Rani Talab Police Station Case No. 37 of 2021, subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
