Mr. Ashok Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-05-2022 Heard Mr. Krishna Prasad Singh, learned Senior Counsel assisted by Mr. Saket Kumar for the petitioners and learned APP for the State.

Petitioners apprehend their arrest in connection with Paraiya P.S. Case No.09 of 2021, registered for the offences punishable under Sections 283, 147, 148, 149, 341, 325, 307 and 353 of the Indian Penal Code.

Allegation against the petitioners is of pelting stones on the police personnel causing injury to the informant. Learned Senior Counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. There is general and omnibus allegation against all

It is further submitted that allegation against the petitioners and 28 named other co-accused persons is of pelting stones on the police personnel but only the informant sustained injury. It is also submitted that the petitioners were the members of the mob. It is submitted that petitioners no.1, 2 and 4 have got no criminal antecedent and petitioner no.3 has got one criminal antecedent as stated in paragraph-3 of the bail application. It is lastly submitted that the injury is simple in nature. Learned APP for the State opposes the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Paraiya P.S. Case No.09 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
