2. The petitioner, in the present case, is seeking prearrest bail in connection with Revelganj P.S. Case No.75 of 2017 registered for the offences punishable under Sections 420, 467 and 468 of the Indian Penal Code and Section 138 of the N.I. Act. The petitioner has got one criminal antecedent.

3. As per the prosecution story, the petitioner has received some consideration amount from the complainant for registering a piece of land in favour of the complainant which he has not done.

4. Learned counsel for the petitioner submits that petitioner is ready to pay Rs. 9 lacs to the informant in two

Patna High Court CR. MISC. No.44175 of 2023(2) dt.04-08-2023 2/3 installments of Rs.4,50,000/- each, first installment of Rs.4,50,000/- shall be deposited/paid at the time of submission of bail bond and the another one will be paid within one month thereafter.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Having regard to the submission that the petitioner is ready to pay Rs. 9 lacs to the informant in two installments of Rs.4,50,000/- each, first installment of Rs.4,50,000/- shall be deposited/paid at the time of submission of bail bond and the another one will be paid within one month thereafter, this Court directs that without prejudice to the case of the petitioner and the informant, in case of his arrest/surrender within a period of four weeks from today, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Chapra, District-Saran in connection with Revelganj P.S. Case No. 75 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. And further condition that the petitioner shall pay Rs. 9 lacs to the informant in two installments of Rs.4,50,000/-

Patna High Court CR. MISC. No.44175 of 2023(2) dt.04-08-2023 3/3 each, first installment of Rs.4,50,000/- shall be deposited/paid at the time of submission of bail bond and the another one will be paid within one month thereafter.

8. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
