JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 308, 504, 506 and 34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that though there is allegation of assault by Garasa on the hand of the informant but the injury on the person of the informant is simple and there is case and counter case. There is injury from the petitioner side also.

Learned Additional Public Prosecutor could not controvert the above fact.

In view of the aforesaid facts, the petitioner, above

Patna High Court Cr.Misc. No.55148 of 2016 (2) dt.13-01-2017 2/2 named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 23/2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that the petitioner will make available himself before the police/court, as the case may be, as and when required.
