As per the allegation in the FIR, the petitioner has filed instant application for bail in a case under Section 395 of the Indian Penal Code registered against 6-7 unknown persons who are said to have looted Rs.7.88 lacs from the bank. It is submitted by learned counsel for the petitioner that the petitioner was caught on suspicion, in course of investigation. However, no incriminating article has been recovered from his possession. He is in custody since 07.03.2019 and charge sheet has been submitted in this case. It is further submitted that the case of the petitioner stands on similar footing to that of co-accused who have been granted bail by this Court by order dated 16.07.2019 passed in Cr. Misc. No.32125/2019, order dated 04.09.2019 passed in Cr.

Patna High Court CR. MISC. No.44728 of 2019(4) dt.06-11-2019 2/2 Misc. No.38950/2019 and order dated 24.09.2019 passed in Cr. Misc. No.60595/2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the above facts including the grant of bail to other similarly situated accused persons, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patna cum Sub-Judge-XV, Patna in connection with Rajeev Nagar P.S. Case No.34/2019.
