JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Informant, a hotel manager had alleged that while his Room No.201 was being occupied by one Anand Shankar Ojha, petitioner along with others came on the pretext of meeting with him, gone inside Room No.201 and bolted. Police came and after opening the room petitioner along with others was found engaged in gambling. Huge amount as per seizure list was also recovered. It has been submitted on behalf of petitioner that instant case should not have been drawn up against the petitioner because of the fact that neither he had taken the room on rent nor he was staying there. Whatever allegation or grievances may have, that was against Anand Shankar Ojha. Also submitted that Buxar Town P.S. Case No.440/2016 has been registered with regard to gambling. The learned Additional Public Prosecutor opposed the prayer.

Considering the nature of the allegation inconsonance with the period of detention since 22.09.2016, petitioner Rajendra

Patna High Court Cr.Misc. No.49165 of 2016 (2) dt.15-12-2016 Kumar Verma is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S.
