JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and Section 47(a) of Excise Act. Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 12.01.2016 passed in Cr. Misc. No. 1002 of 2016 but submission on behalf of the petitioner is that only pouches, punching machine etc. are said to have been recovered and according to prosecution case itself, no liquor had been recovered from possession of the petitioner and moreover, petitioner is in jail custody since 08.10.2015.
