JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code. Taking into consideration that petitioner gave fatal blow causing head injury to deceased as a result whereof, deceased died then and there, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Powakhaali P.S. Case No. 16 of 2016 pending in the court of Sri Firoz Akram, Judicial Magistrate 1st Class, Kishanganj stands rejected.
