JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioners is of killing of son of informant.

It has been submitted on behalf of petitioners that they are in custody since 2.8.2016 and 16.8.2016 respectively. They have got no criminal antecedent. Chargesheet has been submitted against petitioners. No allegation of tampering of witnesses is alleged against petitioners. They have been made accused merely on the basis of suspicion. There is no substantive evidence to suggest their implication in the present case. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties

Patna High Court Cr.Misc. No.51435 of 2016 (2) dt.06-12-2016 2/2 of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Barhara P.S. Case no. 245 of 2016.
