The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 308/34 of the Indian Penal Code. It is alleged that the petitioners came armed with lathi and danda in drunken condition and abused the informant. On protest being made, the petitioners assaulted the informant, caused injury on right eyebrow. When son of the informant case to rescue, he was assaulted on his head by co-accused Meena Devi. It is submitted by the learned counsel for the petitioners that petitioners are the own brother of the informant. The injuries have been found to be simple in nature.
Patna High Court Cr.Misc. No.36331 of 2015 (2) dt.08-09-2015 Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Moreover, the specific accusation of assault on head of the son of the informant is against Meena Devi.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Rahui P.S. Case No. 170 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
