2. The petitioner seeks bail in Sandesh P.S. Case No. 56 of 2024 registered for the offence punishable under Sections25(1-B)a and 26 of the Arms Act.
3. Allegedly, one loaded country-made pistol and two live cartridges are said to have been recovered from possession of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The allegations levelled in the first informant report are false and concocted. The alleged recovery has been made from an open place. It will not be out of place to mention here
Patna High Court CR. MISC. No.43726 of 2024(5) dt.07-10-2024 2/2 that the occurrence took place in broad daylight, however, during investigation, not a single witness has come forward to support the prosecution case. The petitioner is under incarceration since 22-03-2024.
5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Sandesh P.S. Case No. 56 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
7. Before accepting the bail bonds, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any other case except the case(s), mentioned in paragraph-3 of the bail petition, his bail bonds shall not be accepted.
