The own sister of the petitioner lodged Bihar P.S.case No. 194 of 2015 on 30.04.2015 against the petitioner and on the date of the present occurrence, the informant and others police officials went to nab the petitioner but petitioner made indiscriminate firing. Anyhow, petitioner was over powered by the police officials and two loaded katta and more than 30 live cartridges and 10 empty cartridges were recovered from his possession.
Submission on behalf of the petitioner is that there was dispute between the petitioner and his sister and, as a matter of fact, police lodged this case at the behest of sister of the petitioner.
Patna High Court Cr.Misc. No.38610 of 2016 (2) dt.28-09-2016 2/2 It is also pointed out that prior to registration of the present case as well as the cases as mentioned in Para-3 of the petition , petitioner had not been made accused in any other case.
Considering the period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Nalanda at Biharsharif in connection with Bihar P.S.Case No. 196 of 2015.
