The petitioner seeks bail in Vaishali P.S. Case No. 138/2019, instituted for offence under Section(s) 30(a), 32(2) and 41(1) of the Bihar Prohibition and Excise Act. It is alleged in the written report that on getting secret information, police party reached at the place of occurrence and arrested this petitioner. It is alleged that petitioner disclosed name of all the accused persons who were unloading the truck and fled away after seeing the police party. On search total 6201 litres of illicit liquor were recovered from the aforesaid truck. Seizure-list is part of F.I.R., from which it appears that recovery of illicit liquor has been made from the land of Dayashankar Singh, which is alleged to be given by him to
Patna High Court CR. MISC. No.41310 of 2019(2) dt.10-07-2019 2/2 his son-in-law Manish Kumar.
Petitioner is in custody since 15.04.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Prohibition and Excise, Vaishali, Hajipur in connection with Vaishali P.S. Case No. 138/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
