The petitioner has filed the instant application for grant of regular bail in connection with Nawada Nagar P.S. Case no. 429 of 2017 registered under sections 406 and 420 of the Indian Penal Code and section 138 of the Negotiable Instrument Act.

As per allegation in the F.I.R., a sum of Rs. 5 lacs had been taken by the petitioner and he issued a cheque for returning the said amount. It is stated by the informant that the cheque bounced and as such the F.I.R.

It is submitted by learned counsel for the petitioner that the allegation in the F.I.R. is one of purely civil dispute. It is submitted that he is in custody since 13.6.2018.

Having heard learned counsel for the parties and taking into consideration the period in custody i.e the petitioner being in custody since 13.6.2018, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Nawada Nagar P.S. Case no. 429 of 2017 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada.
