2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 96, 64(1), 351(2), 352, 115(2) and 3(5) of BNS and Sections 4 and 6 of the POCSO Act.
3. The case of the prosecution is that one Mithu Kumar has kidnapped the minor daughter of the informant. It is alleged that when the informant went to complain with the family members of the petitioner, the petitioner is who is brother-in-law of Mithu Kumar, he along with other family members started abusing and assaulting.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that main thrust of allegation is against Mithu Kumar and even the petitioner is resident of different village. There is no allegation against the petitioner save and except abusing and assaulting which is general and omnibus. Moreover, the petitioner is languishing in judicial custody since 03.05.2026.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Madhubani P.S. Case No. 39 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judgecum-Special Judge (POCSO), Purnia.
