The Petitioner seeks quashing of the order dated 19.2.2015 by which the Adhoc A.D.J. III, Rohtas at Sasaram has set aside the order dated 12.11.2013 passed by the Judicial Magistrate, 1st Class, Sasaram, in Complaint Case No. 673 of 2004, Trial No. 1094 of 2014 by which he had disallowed an application under Section 311 Cr. P.C.

Since the Complainant must get an opportunity to test his case by adducing evidence, Sri Ambika Prasad Chaudhary, Judicial Magistrate, 1st Class, Sasaram, is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with Complaint Case

Patna High Court Cr.Misc. No.33115 of 2015 (2) dt.27-07-2015 2/2 No. 673 of 2004, Trial No. 1094 of 2014, to the Superintendent of Police, Sasaram, and the Superintendent of Police, Sasaram, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial. He is further directed to conclude the trial positively within a period of four months from the date of receipt of this order without granting unnecessary adjournment to any Party.
