Petitioner apprehends his arrest in Piro P.S. Case No.180 of 2017, registered under Section 392 of the Indian Penal Code.

The informant claimed to have identified the three accused persons who robbed him.

Learned counsel for the petitioner submits that petitioner is not named in the FIR. Name of the petitioner surfaced in the case in the confessional statement of a coaccused and there is no recovery but it appears that the petitioner has got criminal antecedents and he is accused in two other criminal cases, Charpokhari P.S. Case No.173 of 2017, registered under Sections 392, 325 and 412 of the Indian Penal Code and Charpokhari P.S. Case No.84 of 2017, registered

Patna High Court CR. MISC. No.40129 of 2019(2) dt.01-07-2019 2/2 under Section 394 of the Indian Penal Code. Once the informant claimed to have identified the accused during the course of investigation, the accused on being apprehended is required to be put on TIP.

Taking into consideration the facts aforesaid and the fact that petitioner has got criminal antecedents, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
