The petitioners being the parents of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The accusation is of killing the daughter of the informant after three years of marriage for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family. On conclusion of investigation, the husband was chargesheeted under section 498A IPC whereas, the petitioners were not

Patna High Court Cr.Misc. No.34776 of 2015 (2) dt.19-08-2015 2/2 sent up for trial, but differing with the final form, the learned CJM took cognizance under sections 498A and 306 IPC against the petitioners also.

Considering the fact that accusation was not found true, during investigation, against the petitioners, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai in connection with Begusarai Muffasil P.S. Case No.260 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
