The petitioner seeks bail in a case registered under Sections 376/511 of the Indian Penal Code and Section-8 of the POCSO Act.

Allegation against the petitioner is of attempting to commit rape upon 14 years sister of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 30-03-2019. The petitioner has been falsely implicated in the present case due to village politics. The allegation, made in the FIR is denied by the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge (POCSO) Act, Bhagalpur in connection with Kahalgaon Budhuchak P.S. Case No. 16 of 2019.
