Learned Counsel for the petitioner submits that the present case arises out of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989 and in stead of filing appeal, under Section 14A (2) of the of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989 , the present criminal miscellaneous application has been filed. Accordingly he seeks permission to withdraw this application with liberty to file an appeal under Section 14A (2) of the of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989. Permission is granted.

This application is dismissed as withdrawn with the liberty aforesaid.
