The instant application is renewed by the petitioner for regular bail which has been filed in connection with Rajepur P.S. Case No. 92 of 2023 instituted for the offence u/s 302, 120(B)/34 of the Indian Penal Code and Section 27 of Arms Act.

Earlier the application for regular bail of the petitioner was rejected by order dated 28.08.2023 passed in Cr. Misc. No. 47865 of 2023 with an observation to learned trial court to expedite the trial and conclude the same as soon as possible.

It is a case of commission of murder by the

Patna High Court CR. MISC. No.44002 of 2024(2) dt.02-07-2024 2/2 petitioner by opening fire upon the head of the informant's brother namely, Raj Kumar Ray.

A supplementary affidavit has been filed on behalf of the petitioner to the effect that during trial prosecution witnesses including the informant have declared hostile since they did not support the case of prosecution. A statement to that effect has been made in para 3 of the Supplementary affidavit.

On that view of the matter, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Rajepur P.S. Case No. 92 of 2023 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XI, East Champaran, Motihari.
