1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 205 and 120(B)/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent.

4. The informant alleges that petitioner is a victim of a forged sale deed executed by Surya Narayan Singh in favour of Vinod Kumar Singh of the land of the informant by altering the boundary.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is further submitted that informant and Surya Narayan Singh are

Patna High Court CR. MISC. No.41839 of 2023(2) dt.17-07-2023 2/2 cousin and the petitioner was completely unaware that dispute relating to land was existing in between the brother. It is next submitted that the sale deed executed by Surya Narayan Singh in favour of Vinod Kumar Singh was witnessed by the petitioner. It is thus submitted that the petitioner is merely a witness on the sale deed and the informant and the petitioner are relatives.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mashrakh P.S. Case No. 383 of 2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
