2. The petitioner has preferred this application for grant of regular bail in connection with Dhoraiya P.S. case No. 30 of 2026 registered for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 118(1), 109, 303(2), 352, 351(2) of the BNS.

As per the prosecution case, on 27.01.2026 at about 7:30 P.M., a dispute arose over the contribution for prasad during Saraswati Puja, whereupon co-accused Ranveer Singh started abusing and assaulting the husband of the informant. Upon hearing the commotion, the informant reached the place of occurrence and found that the petitioner along with other coaccused persons variously armed with weapons, had surrounded

Patna High Court CR. MISC. No.45316 of 2026(2) dt.08-07-2026 2/3 her husband. When the informant came to rescue her husband, the petitioner allegedly assaulted her on the head with an iron rod. Thereafter, when the nephew of the informant came to rescue, co-accused Abhishek Singh allegedly assaulted him on the head with an axe (kulhari), causing him to sustain a grievous injury. It is further alleged that when the informant's sister-inlaw, namely Urmila Devi, came to intervene, co-accused Ranveer Singh attacked her on the head with an iron rod as a result of which she became unconscious and fell on the ground. It is further alleged that co-accused Savita Devi snatched the informant's gold chain.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It has further been submitted that there is a case and counter case between the parties and the occurrence took place suddenly without any premeditation to kill. It has also been submitted with reference to Annexure-2, that the injury sustained by the informant is simple in nature. It has further been submitted that the charge-sheet has already been filed and there is no allegation of tampering with the evidence against the petitioner. It has lastly been submitted that the petitioner has one criminal antecedent in which he is on bail and

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner. Learned counsel for the informant has submitted that the petitioner attacked the informant on her head, due to which she sustained injuries, which shows the active participation of the petitioner in the alleged occurrence.

6. Heard the parties and perused the record.

7. Considering the above facts and circumstances of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka, in connection with Dhoraiya P.S. case No. 30 of 2026.

8. The application stands allowed.
