The petitioner seeks bail in Barauni Rail P.S. Case No. 2/2000, registered for the offences punishable under Section 395 of the Indian Penal Code.
The prosecution case, as per fardbeyan, is that the informant was travelling in a train bearing no. 4083 in Coach no.
1. It is alleged that 6-7 unknown miscreants armed with pistol committed dacoity in the train. They assaulted the informant and other co-passengers and snatched their belongings from their possession. Thereafter they all deboarded from the train. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the case merely on confessional statement of Vijay Rai @ Vijay Mahto and except
Patna High Court Cr.Misc. No.641 of 2017 (2) dt.11-01-2017 2/2 that nothing is against this petitioner. In this case, final form was submitted but after 4 years the Magistrate took cognizance. It was further submitted that similarly situated co-accused Wakil Bind has been allowed bail in Cr. Misc. No. 51955/2016. This petitioner also deserves same benefit.
Learned Additional P.P. opposes the submission but he concedes that similarly situated co-accused has been allowed bail. Considering the case of this petitioner on similar footing and also the facts and circumstances, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 2/2000.
