The petitioner is in custody since 23.05.2019 in connection with Hilsa P.S. Case No. 608 of 2018 registered for the offence punishable under Sections 272/273/34 of the I.P.C. and Section 30(a)/38/41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from a PACCS godown with which the petitioner has got no concern. It is further submitted that the petitioner has been implicated due to dirty village politics and has no criminal antecedent.

Considering the aforementioned facts and

No.41789 of 2019(3) dt.16-09-2019 2/2 circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District and Sessions Judge cum Special Judge, Excise, Nalanda at Biharsharif, in connection with Hilsa P.S. Case No. 608 of 2018.
