2. The petitioner apprehends his arrest in connection with Koilwar P.S. Case No. 208 of 2024, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 385, 386 & 504 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly while the driver of the informant was carrying sand on his tractor, in the meanwhile, all the FIR named accused persons including the petitioner intercepted and demanded a rangdari of rupees five hundred, which could not be fulfilled by the driver. Patna High Court CR. MISC. No.39045 of 2025(4) dt.15-10-2025 2/3 the petitioner who happens to be owner of the tractor, reached to the house of co-accused person. Thereupon, co-accused person threatened with dire consequences and in the night of the fateful day, co-accused persons barged into the house of the informant and made indiscriminate firing. The driver of the informant sustained fire arm injury over his jaw, due to which he got seriously injured.

4. Learned Advocate appearing on behalf of the petitioner taking this Court through the FIR submitted that the occurrence is in two part. The first occurrence had taken place two days prior to the fateful incidence of causing fire arm injury to the driver of the informant, wherein, it is alleged that altogether nine persons intercepted the tractor and demanded rangdari. There is no allegation against the petitioner of any overt act, except he being named in the FIR, participated in the crime of demanding five hundred rupees. In the second incidence, the name of the petitioner has not ever been taken by the informant. It is further submitted with regard to the first incidence, there is no eye witness to the alleged occurrence and only in order to put pressure, the present FIR has been instituted. All the more, the petitioner is a man of fair antecedent and he undertakes before this Court that he will fully cooperate

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the petitioner has actively participated in the crime.

6. Regard being had to the submissions made on behalf of the parties and considering the nature of accusation levelled against the petitioner, coupled with the fair antecedent, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No. 208 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
