JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 19.03.2015. The trial court has reported that the trial of the petitioner is pending for recording the evidence of two investigating officers. However, the trail court has sought three months time for conclusion of trial of the petitioner. Regard being had to the facts and circumstances as well as submission of the parties, the bail prayer of the petitioner in connection Singheshwar P.S.Case No. 151 of 2014 arising out of Session trial no. 106 of 2015 stands rejected.
Patna High Court Cr.Misc. No.36176 of 2018 (4) dt.10-10-2018 2/2 However, petitioner may renew his prayer for bail after three months, if his trial is not concluded within three months.
This order shall be communicated to the learned Session Judge, Madhepura in connection with Session trial no. 106 of 2015 without any delay.
